Terms & Conditions

All sales to the customer are concluded under BMS’s trading terms and conditions:

Prices and Payment

  1. Price Quotations: Prices quoted are in South African Rand (ZAR), subject to the rate of exchange, and are valid for 30 days.
  2. Ownership: All goods remain the sole property of BMS until paid in full.
  3. Bank Charges: All bank charges/fees are the customer’s responsibility. Items equivalent in value to bank charges will be removed from the customer’s order if not paid for.

Ordering

  1. Confirmation and Acceptance: Confirmation of the order to be sent via email; telephonic orders will not be accepted.
  2. Special Orders: Specially manufactured/non-stock items CANNOT be exchanged, cancelled, or returned after the order is placed and will only be ordered upon payment in full.
  3. Replacement Parts: We do not supply replacement parts for equipment from other suppliers unless agreed upon. The customer bears full responsibility for such parts, and orders will only be processed upon payment in full.

Delivery

  1. Delivery Time: Delivery time is indicative, and BMS cannot be held responsible for any delays.
  2. Inspection: All goods must be checked on delivery, and the invoice signed. No queries regarding breakages will be entertained after 7 working days.
  3. Responsibility: Responsibility for products ceases upon delivery to the transport company in good condition.
  4. Customer’s Carrier: In cases where delivery is made by the customer’s carrier, the carrier is deemed the customer’s agent, and risk passes onto the customer upon the carrier’s acceptance of delivery.

Returns

  1. Approval Required: Please contact ops@bmseducation.co.za as goods will not be accepted for return unless approved by BMS.
  2. Client Responsibility: The suitability of the goods for any intended use is the sole responsibility of the client.
  3. Exchange/Credit: Items correctly supplied by BMS but incorrectly ordered by the client may be exchanged/credited within a 30-day period, subject to a restocking charge.
  4. Post 30 Days: After 30 days, exchange/credit may be entertained at BMS’s discretion, provided goods are complete and in their original packaging. Pro-rata costs may apply.

Warranty/Guarantee/Refunds (Count from date of order)

  1. Guarantee and Warranty: All goods sold with a 30-day guarantee and a 1-year limited warranty. Refunds apply only within this period for defective or faulty items.
  2. Repair Policy: After 30 days, mechanically faulty equipment will be repaired, or a credit issued, subject to terms.
  3. Return Process: All items must be returned to BMS for assessment by technicians.
  4. Voidance: Guarantee/Warranty is void if the product is found to be abused or incorrectly used.
  5. Condition of Returns: Goods must be returned complete and in their original packaging.
  6. Post 1 Year: After 1 year, mechanically faulty equipment will be subject to a quote.

Samples/Approval Goods

  1. Approval Process: Samples/approval goods require approval/supervision by BMS personnel.
  2. Legal Documentation: If approved, appropriate legal documentation must be signed, and the customer is responsible for any damages.

Accounts

  1. Application Process: Accounts are provided after regular purchasing over a 3-month period, subject to completion of an application form and credit checks.
  2. Terms: BMS reserves the right to approve accounts and set limits at its discretion.
